Kevin P. Smith’s practice is concentrated in the area of property casualty and insurance litigation since graduation from law school in 1985. He has extensive trial and appellate experience in state and federal courts throughout the United States. Mr. Smith’s experience includes subrogation actions arising from building fires, flooding and water damage, warehouse losses and construction accidents. He has also successfully litigated many ocean marine and inland marine cargo damage subrogation claims.
Mr. Smith has obtained numerous favorable trial verdicts for subrogated insurers in several different states, including many seven figure verdicts. He has also obtained numerous seven figure recoveries through mediations and arbitrations. Mr. Smith has extensive experience in managing the investigation of very large losses involving multiple parties and experts. He has developed specialized knowledge in the area of product liability cases involving plastic plumbing components, metal halide lights, highly combustible plastic materials and solar electric arrays, in addition to boiler and machinery losses.
Mr. Smith has presented numerous seminars on subrogation topics at the annual conferences of The National Association of Subrogation Professionals (NASP), the Property Loss Research Bureau (PLRB) and National Property Subrogation ExecuSummit. His seminar topics have included fire spread claims, subrogation damages, pyrolysis as a source of ignition and prosecuting claims with insureds. Articles on subrogation topics written by Mr. Smith have been published in Claims Magazine and The Subrogator.
From 1993 to 1997, Mr. Smith was co-editor of the Practice and Procedure Newsletter published nationally by the Maritime Law Association and the American Bar Association. Before joining Stutman Law, Mr. Smith was a member of the Philadelphia firm of Clark, Ladner, Fortenbaugh and Young.
Mr. Smith received his undergraduate degree from Lehigh University in Bethlehem, P.A. in 1982. In 1985, he earned his law degree from Wake Forest University in Winston-Salem, N.C.
Mr. Smith is admitted to practice law in the state courts of New Jersey, New York and Pennsylvania; the United States District Courts for the Eastern District of Pennsylvania, the District of New Jersey, the Southern District of New York, the Eastern District of New York and the Western District of New York; and the Third Circuit Court of Appeals.
Mr. Smith has been active in local government, serving as Vice Chairman of a municipal zoning board for a number of years.
