A water loss in New Mexico was caused by a newly installed cartridge in a faucet. The faucet installer, a certified plumber, replaced the cartridge only a few weeks prior to the loss. The plumber’s insurance carrier denied liability, claiming that the loss resulted from a product defect attributable to the faucet’s manufacturer. Given this defense, our office arranged a destructive examination and invited the plumber and the faucet’s manufacturer to participate. After the plumber’s carrier opted not to attend the examination, we conducted the relevant testing along with the manufacturer. At the conclusion of that testing, our expert had obtained unequivocal evidence that the loss was caused by improper installation of the cartridge, not a product defect. Faced with the evidence, the plumber’s carrier resolved the claim.
