A water filter that was installed under the insured’s kitchen sink cracked and caused significant water damage to the insured’s property. Stutman Law was able to establish through expert testimony that the filter failed due to a defect during the manufacturing process. It was the manufacturer’s position that the product failed due to over-tightening of the canister. Stutman Law argued that even if the canister failed due to over-tightening, it is foreseeable that the product could be over-tightened and there were no warnings placed on the product by the manufacturer to warn against over-tightening. The arbitration panel found for Stutman Law’s client.
