Stutman Law recovered $200,000.00 on a smoke damage claim caused by a defective floor fan. At the outset of our investigation, we coordinated an engineering evaluation and examination of the fire damaged remains of the fan. Our expert determined that the fan had overheated and catastrophically failed despite the thermal protection devices within the fan, which should have prevented serious overheating and shut the fan motor off prior to ignition. Instead, the thermal protection did not function as intended, the motor overheated and the fan’s plastic housing ignited. Based on the results of the engineering evaluation, Stutman Law was able to negotiate a favorable pre-litigation settlement with the distributer of the fan.
