Stutman Law obtained a significant recovery for its client related to a water loss caused by a bidet failure. The bidet failed at a plastic “T” fitting. The bidet manufacturer denied liability for the loss, claiming that a metal “T” fitting had been sent to the insured to replace the plastic fitting prior to the loss. The manufacturer supplied no proof of this. However, Stutman Law argued that if the manufacturer had in fact sent a replacement part as it claimed, then the manufacturer had known and effectively conceded that the original plastic part was defective. The manufacturer agreed to favorably resolve the claim pre-suit.
