Stutman Law was retained to pursue viable subrogation targets after the roof of an outdoor patio collapsed at an Indianapolis restaurant. The initial investigation revealed that the failure occurred due to an excessive accumulation of water on the patio roof. A roof drain had been blocked, and unfortunately the patio was not constructed with a secondary drain. Our experts performed a structural analysis, which also demonstrated that the connection of the roof to the restaurant’s masonry wall was insufficient to carry the loads prescribed by relevant building codes. Stutman Law asserted negligence claims against numerous contractors and subcontractors involved with the construction of the outdoor patio. The case was ultimately settled following the exchange of written discovery, without incurring the expenses associated with depositions, motions practice or trial.
